12.  Management failed to process a CA-7 for 51 days. Arbitrator stated management violated ELM 545.14 and Art 19 and awarded interest payment  made

Issue:  Did the Postal Service violate the parties Labor Agreement by taking 1 ½ to 2 months to complete and forward grievants CA-7 to O.W.C.P.?  If so, what is the remedy?

 

UNION POSITION:

    

     The grievant filled out a CA-7 for a payment of over $39,000.00.  Management violated ELM 545.14 by not completing and sending the CA-7 within a timely fashion.

 

MANAGEMENT’S POSITION:    

 

     Management claims that there was a backlog and other CA-7’s for back pay were given preference.  They also said that the amount of money and records to go through were extensive.

 

AWARD:

 

     The Postal Service is to pay the grievant the applicable federal rate for the number of days encompassing February 11, 1997 through March 31, 1997 on the above stated amount.
